Adds PC 653.25 to create a new misdemeanor for loitering in a public place with the intent to purchase commercial sex and specifying requisite evidence of intent. |

The bill would also exempt an emergency physician who is responsible for the detainment of a person under those provisions from criminal and civil liability. |

Repeals and adds PC 463 to recast the offense of looting to include 1st degree burglary, 2nd degree burglary, grand theft, trespass, and theft from a vehicle, when those offenses are committed in an evacuation zone, to the crime of looting. For the purposes of the offense of looting, defines an evacuation zone to include an evacuation area or an area subject to an evacuation warning, and to include any residential dwelling units in such an area for a period of one year after the evacuation order, or up to 3 years if the property is undergoing construction. Increases penalties for these offenses committed within an evacuation zone. |

The bill’s provisions do not apply if the immediate family member is under custodial interrogation or if the delay would result in the loss or destruction of evidence or pose an imminent threat to public safety. |
