AB 0243: Postsecondary education: student financial aid dependency status: juvenile case file inspection Delinquency

Adds WIC 826.9 to require higher education institutions to accept an attestation from a local education agency, county probation department, or welfare department as proof of current or former ward’s or dependent’s financial independence for the purposes of admissions or financial aid applications. All information received by higher institution is confidential; creates a misdemeanor punishable by fine for intentional violation of confidentiality.

AB 0309: Hypodermic needles and syringes Criminal

Enacted.

Amends BPC 4145.5 and HSC 11364 to delete the January 1, 2026 repeal date and extend the provisions indefinitely. The provisions authorize physicians and pharmacists to provide hypodermic needles and syringes with or without a prescription to those over 18 years old for personal use.

Amends PC 17 to allow judges to classify a wobbler as a misdemeanor at any time prior to trial. If a motion to classify a crime as a misdemeanor under this provision is denied, a renewed motion may only be made upon a showing of changed circumstances. Updates outdated terminology from “the Division of Juvenile Justice” to “a secure youth treatment facility”.

Amends PC 422 to authorize the sentencing court to consider, as a factor in aggravation, that the defendant willfully threatened to commit a crime that would result in the death or great bodily injury of a person the defendant knew was a state constitutional officer, a Member of the Legislature, or a judge or court commissioner, as specified.

Amends many VC provisions related to ignition interlock devices to extend the operation of these provisions until January 1, 2033.

AB 0379: Crimes: prostitution Criminal

Amends PC 647 to increase the penalty for solicitation to a wobbler (previously a misdemeanor) plus a $1,000 fine where solicited minor is more than three years younger than defendant. A defendant convicted of this wobbler and granted probation must complete an education program on human trafficking and the exploitation of children at no cost to defendant.

Adds PC 653.25 to create a new misdemeanor for loitering in a public place with the intent to purchase commercial sex and specifying requisite evidence of intent.

AB 0383: Firearms: prohibition: minors Delinquency

Amends PC 1524, 29615, and 29810 to authorize the issuance of a search warrant for minors unlawfully in possession of a firearm, expand the exemptions prohibiting minors from possessing firearms, apply existing firearms relinquishment procedures to adjudicated minors, and disarm certain adjudicated minors until age 30.

Amends PC 243.3 to expand the crime of battery against transportation personnel or passenger to apply to an employee, public transportation provider, or contractor of a public transportation provider.

AB 0416: Involuntary commitment Civil Commitment

Amends WIC 5113 and 5121 to require a county behavioral health director to include emergency department physicians as eligible to be designated to perform the involuntary hold and treatment functions under WIC 5150. The bill would also exempt an emergency physician who is responsible for the detainment of a person under those provisions from criminal and civil liability.

AB 0468: Crimes: looting Criminal

Amends PC 459 to clarify that The fact that the structure entered has been damaged by a natural or other disaster, or the extent of that damage, does not preclude conviction for burglary. Repeals and adds PC 463 to recast the offense of looting to include 1st degree burglary, 2nd degree burglary, grand theft, trespass, and theft from a vehicle, when those offenses are committed in an evacuation zone, to the crime of looting. For the purposes of the offense of looting, defines an evacuation zone to include an evacuation area or an area subject to an evacuation warning, and to include any residential dwelling units in such an area for a period of one year after the evacuation order, or up to 3 years if the property is undergoing construction. Increases penalties for these offenses committed within an evacuation zone.

AB 0476: Metal theft Criminal

Amends PC 496a to expand the list of materials and items that junk dealers and recyclers are prohibited from possessing to include, among other things, items reasonably recognizable as street lights and related equipment, and would increase the maximum amount of the criminal fine to $5,000. Amends PC 496e to increase the maximum fine to $5,000 if a junk or metal dealer/collector knowingly buys/receives items belonging to entities like railroad or utilities companies.

Amends PC 466 to add key programming devices, key duplicating devices, and signal extenders to the list of instruments that are an element of the crime of misdemeanor possession of burglary tools.

AB 0509: Alcoholic beverages: minors Criminal

Amends BPC 25660 to provide that the use of an active age verification software or device to establish the age of a purchaser of alcoholic beverages that fails to identify a false ID card is considered evidence in a defense against any misdemeanor prosecution against the licensee if the ID is bona fide evidence and was physically inspected, is seemingly legitimate, and matches the physical appearance of the customer.

Amends PC 136.1 to change the “and” in subdivision (b)(2) to “or”, clarifying that post-charging dissuasion alone is sufficient to establish guilt under the statute.. Enacted in response to People v. Reynoza (2024) 15 Cal.5th 982, which held PC 136.1 does not permit a conviction to be based solely on proof of dissuasion from “assisting in the prosecution” of an already-filed charging document. (Id. at p. 1013.)

Adds Ch. 17.43 to GC, commencing with GC 7287, to require a peace officer or a prosecuting attorney, before any initial formal interview of an immediate family member of a person who has been killed or seriously injured by a peace officer, to clearly identify themselves and if the interview takes place in person, to show ID, to inform the person of the status of their family member, to inform the person that they are conducting a formal interview for the purposes of an investigation, as specified, and to inform the person that they have a choice to come to the station for the formal interview if they are asked to go and can have a trusted support person with them. The bill’s provisions do not apply if the immediate family member is under custodial interrogation or if the delay would result in the loss or destruction of evidence or pose an imminent threat to public safety.

AB 0651: Juveniles: dependency: incarcerated parent Delinquency; Dependency

Amends PC 2625 to require notice of, and the opportunity for an incarcerated parent to be physically present in, specified dependency hearings relating to their child. Requires an incarcerated parent who has waived the right to be physically present to be given the opportunity to participate in those proceedings by videoconference, and, if videoconferencing technology is not available, require the use of teleconferencing. Amends WIC 349 to expand the provisions to include nonminor dependents.

AB 0812: Recall and resentencing: incarcerated firefighters Criminal

Amends PC 1172.1 to require CDCR, no later than July 1, 2027, to promulgate regulations re: the referral of participants in the California Conservation Camp program and incarcerated persons working at institutional firehouses for resentencing. The regulations must (1) authorize referral for resentencing for eligible inmates who have 2 or more years remaining of their prison sentence; (2) prohibit exclusion from resentencing consideration based solely on past/pending parole hearing dates; and, (3) prohibit imposition of minimum time served requirements as a condition for resentencing consideration.
