Recent Victory Highlight

Recent highlights from our victory blog include two case in which convictions were reversed following jury trials: one for a statute of limitations violation and one for instructional error.

In People v. Cauyong, No. A125119, the Court held that four counts of lewd and lascivious acts must be reversed because there was a lack of evidence that they were timely prosecuted under PC 801.1(a). Our victory blog post on Cauyong, which includes a link to the opinion, is posted here.

In People v. Sojka, No. A127831, the Court of Appeal found that the trial court prejudicially erred by failing to instruct the jury that the defendant could not be found guilty if he reasonably but mistakenly believed the victim consented to intercourse.
