Cunningham Decided

The the U.S. Supreme Court decided Cunningham today, holding 6-3 that California's Determinate Sentencing Law is unconstitutional. Here is the link to the opinion:

FDAP should be posting materials on its website by the end of this week, providing preliminary analysis of what steps might be taken depending on what the specific status of your case is. And of course we will continue to post suggestions, advice, and sample pleadings as the impact of Cunningham plays itself out. For those of you attending FDAP's seminar this coming Saturday, we will also devote time there to preliminary ideas about Cunningham.
