TYPES OF POSSIBLE BLAKELY CASES and PROCEDURES FOR RAISING BLAKELY ISSUES IN PENDING APPEALS

Issues under Blakely v Washington (no. 02-1632, June 24, 2004) ____ U.S. ____, 2004 WL 1402697, 2004 DJDAR 758 will be arising in numerous contexts, and this memo does not attempt to cover them all. Rather, we are suggesting some prioritizing of potential Blakely cases among your appeals, and are discussing some possible types of pleadings that would be appropriate depending upon the stage of the appeal. FDAP, along with the other projects, will continue to monitor the Blakely landscape, and will be posting articles and samples of briefing in the coming weeks. We won't be able to cover everything, but we hope to provide much useful guidance and sample briefing as caselaw begins to develop the range of Blakely cases.
